Lack of minimum services is "pure incompetence" of the guardianship

The Union of Judicial Employees (SFJ) today accused the Minister of Justice of blaming the unions for the failure to meet deadlines for presenting detainees for questioning, which results from the "pure incompetence" of the Justice services.

At least 12 detainees will be released today in the Lisbon metropolitan area due to the strike by judicial officers, involving cases of homicide, domestic violence and drug trafficking, a source from the SFJ told Lusa.

"The 25 April holiday fell between two strikes with no minimum services and the detainees who end their 48-hour term between these three days [Wednesday, Thursday and Friday] will exhaust their term before the Saturday morning shift at the Central Criminal Investigation Court" [also known as Ticão], he said.

In a clarification sent today to the media about the fact that minimum services had not been decreed, the Ministry of Justice (MJ) blames the union for not having indicated them in the strike notice, for the stoppage that began on 20 December 2023 and ends on Friday, 26 April, and which took place on Wednesday and Friday mornings.

The MJ adds that in the absence of this indication, the Directorate-General for Justice Administration (DGAJ) asked the arbitration court to decree minimum services, which it decided not to do, with the DGAJ appealing to the Lisbon Court of Appeal, "in a process of an urgent nature, which was filed on 29 December 2023" and which is still awaiting a decision.

However, the president of the SFJ, António Marçal, told Lusa that the absence of minimum services on the days close to 25 April is the result of the "pure incompetence" of the DGAJ, which "did not properly justify the request" for minimum services made to the arbitration board.

Marçal recalled that, in previous situations, when strikes were scheduled for periods that included, for example, municipal holidays, the DGAJ took this into account, requesting that minimum services be decreed for the services in the territorial area covered by the municipal holiday, which was granted.

"The specific situation [of the 25 April holiday] was not raised by the DGAJ. By wanting to blame the union, the minister is going down the wrong path," criticised Marçal, who added that there was no attempt by the government to contact the union to "try to coordinate the situation".
