Disciplinary Council issues clarification before Famalicão-Sporting

The Disciplinary Council of the Portuguese Football Federation made a clarification on Tuesday about the case of Mihaj, whose use in the game later today against Sporting was put into question by Famalicão because the center had reached the limit of five yellow cards last Saturday. In an official note, the CD recalls that "it cannot respond to requests for information from clubs and sports agents about the execution of sanctions" and refers the case to the League.
"If it responded to such requests for information from clubs and sports agents, the Disciplinary Council would be violating the powers legally established in article 43 of the Legal Regime of Sports Federations," the CD of the FPF begins by saying.
"The Disciplinary Regulation of the League, under the terms of its article 276, whose epigraph is "Competence" (for the execution of sanctions), provides in paragraph 1 that "The Committee of Instructors, under the guidance and supervision of the Board of the League, is responsible for the execution of disciplinary decisions. Therefore, consultations on the execution of sanctions related to Professional Football Competitions have always been directed by clubs and sports agents to the League's Committee of Instructors," it explains.
The CD also guarantees that it is not "obliged" to collaborate "informally" with the clubs, stating that the Committee of Instructors and the League are the responsible entities when it comes to executing the sanctions.
"If the clubs and sports agents understood that it would be more appropriate for the Disciplinary Council of the Portuguese Football Federation and not the League's Committee of Instructors to be responsible for answering questions they have about the execution of sanctions, they would have advocated for a change in the Legal Regime of Sports Federations and then promoted a change in the Disciplinary Regulation of the League. Until that happens, the Committee of Instructors and the League have exclusive competence in the execution of sanctions, a competence that they deny if they fail to fulfill the duties to which they are bound," concludes the Disciplinary Council.
