Judge Alexandre de Moraes, of Brazil's Supreme Federal Court (STF), said on Wednesday that there are no concrete elements to indicate that former President Jair Bolsonaro was seeking diplomatic asylum in order to later flee the country when he spent two days at the Hungarian embassy. 

The controversy is over the former Brazilian president's stay at the Hungarian embassy shortly after his home was searched in February.

The action aimed to determine whether Bolsonaro, who is under investigation in several inquiries at the STF, had failed to comply with precautionary measures, such as the prohibition on leaving the country. Moraes understood that he had not and closed the case, maintaining the precautionary measures imposed on the former president of Brazil.

"There are no concrete elements that indicate – effectively – that the investigated intended to obtain diplomatic asylum to evade the country and, consequently, harm the ongoing criminal investigation," he wrote.

In February, Bolsonaro spent two nights at the Hungarian Embassy after his passport was seized, according to the American newspaper The New York Times. The overnight stay occurred shortly after his home was searched in an operation that investigated the organization responsible for an attempted coup to keep him in the Presidency after his defeat in the 2022 elections.

In practice, under international law, since embassies are inviolable areas, Bolsonaro could only be detained in a new operation, with the consent of the Hungarian government.

At the time of the release of the videos, Bolsonaro justified that he has a friendly relationship with Hungary and, in particular, with the ambassador, and that he went to the embassy to talk about geopolitical issues.
