Five more detainees released due to bailiffs' strike

The strike by court employees has led to five more detainees being released today because the deadline for presenting them for judicial interrogation has expired, the Union of Court Employees (SFJ) said.

The detainees in question are suspected of drug trafficking and domestic violence, according to SFJ.

On Wednesday, the union had already announced that the strike by judicial employees had led to the release of 12 detainees involved in cases of homicide, domestic violence, and drug trafficking.

On that day, the SFJ accused the Minister of Justice of blaming the unions for the failure to comply with deadlines for presenting detainees for interrogation, which is the result of the "pure incompetence" of the Justice services.

"The April 25 holiday fell between two strikes without minimum services, and the detainees who completed the 48-hour period between these three days [Wednesday, Thursday, and Friday] exhausted their time before the Saturday morning shift at the Central Criminal Investigation Court" [also known as Ticão], a union source told Lusa.

In a clarification sent that day to the media about the failure to decree minimum services, the Ministry of Justice (MJ) blamed the union for not having indicated in the strike notice for the strike that began on December 20, 2023, and ends on Friday, April 26, and which took place on Wednesday and Friday mornings.

The MJ added that in the absence of this indication, the General Directorate of Justice Administration (DGAJ) asked the arbitration court to decree minimum services, which it decided not to do, and the DGAJ appealed to the Lisbon Court of Appeal, "in an urgent process that was filed on December 29, 2023" and is still awaiting a decision.

However, the president of the SFJ, António Marçal, told Lusa that the absence of minimum services on the days adjacent to April 25 is the result of the "pure incompetence" of the DGAJ, which "did not properly substantiate the request" for minimum services made to the arbitration board.

Marçal recalled that in previous situations, when strikes were scheduled for periods that included, for example, municipal holidays, the DGAJ took this into account, requesting that minimum services be decreed for the services in the territorial area covered by the municipal holiday, which was granted.

"The specific situation [of the April 25 holiday] was not raised by the DGAJ. By trying to blame the union, the Minister is taking the wrong approach," criticized Marçal, who added that there was no contact from the ministry with the union for an "attempt to coordinate the situation."
