South African justice rejected today an action by the African National Congress (ANC), in power since 1994 in South Africa, against the party of its former leader and former President of the Republic Jacob Zuma.

In this regard, the KwaZulu-Natal High Court in the port city of Durban has dismissed the ANC’s claims that the Mkhonto weSizwe Party (MKP) was “illegally” using the same name and logo as its former armed wing uMkhonto we Sizwe [Spear of the Nation in Zulu], known since its formation in 1961 as ‘MK’, the South African press reported today.

ANC provincial spokesperson Mafika Mndebele told the press that the ruling party will appeal the court ruling.

In March, the ANC lost another court bid to have former President Jacob Zuma’s political party, which is contesting the 29 May general elections, deregistered.

The Electoral Court sitting in the Gauteng High Court in Johannesburg ruled that the ANC’s application lacked “merit”, and that the MKP was correctly registered by the Independent Electoral Commission (IEC) in accordance with the electoral laws.

Zuma, who was president from 2009 to 2018, was recalled by the ANC in January.

With about a month to go before the general elections, the MKP has emerged as a strong challenger to the ANC, which continues to decline with a new poll predicting it will get only 37% of the vote in the upcoming elections.

According to the Social Research Foundation (SRF), which conducted the survey, Zuma’s new political party could get 13% of the vote, displacing the radical left Economic Freedom Fighters (EFF) as the third-largest party in the country after the Democratic Alliance (DA).

The polls predict that the ruling ANC could lose its outright majority in parliament for the first time and be forced to broaden its current three-decade-old governing alliance.

The African National Congress (ANC), the former liberation movement led by Mandela, governs in alliance with the South African Communist Party (SACP) and the Congress of South African Trade Unions (COSATU).

South Africa’s general elections on 29 May mark three decades of democracy under the ANC government of Nelson Mandela after the fall of the previous apartheid regime in 1994.
