A Canadian court has ruled that custody of a golden retriever should be shared by a woman who wanted to keep the dog and her ex-boyfriend. The decision in New Westminster, British Columbia, is believed to be the first of its kind since a new law came into effect recognizing pets as family members.
The judge ordered that Stella spend one week with each owner, according to CBS News. "Both the petitioner and the respondent have demonstrated a deep concern for Stella's well-being, and I am satisfied that, in the circumstances, shared custody is appropriate," Justice Scott Nielsen said.
Sahar Bayat, a nurse, and her ex-boyfriend, Omid Mavedati, a veterinarian, bought the dog in August 2020. They were living together at the time, but the couple split up in February 2023.
In the past, courts have typically ruled that the person who purchased a pet is its owner. Under the new law, courts are supposed to consider other factors, such as who provided most of the care for the animal and the emotional bond between the pet and each person.
